1. Acceptance of Terms

By accessing or using Goal Gauntlet ("the Service"), operated by Data Savvy, Inc., you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Goal Gauntlet is a fitness challenge application that enables users to:

• Create and participate in fitness challenges ("gauntlets")
• Track health metrics including steps, calories, distance, exercise, and sleep
• Compete individually or as part of teams
• Optionally contribute to prize pools ("buy-ins") for challenges
• View leaderboards and challenge results

3. Eligibility

You must be at least 18 years old to use the Service, particularly for features involving prize pools. By using the Service, you represent that you meet this age requirement.

4. User Accounts

When you create an account:

• You are responsible for maintaining the security of your account
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use

5. Health Data

By granting health data permissions:

• You authorize us to access your health metrics from Apple HealthKit or Health Connect
• You understand this data will be used to track challenge progress
• You can revoke access at any time through your device settings
• You acknowledge that health data accuracy depends on your device and connected apps

Disclaimer: Goal Gauntlet is not a medical device. Health data is for fitness tracking purposes only and should not be used for medical decisions.

6. Prize Pools and Payments

Buy-ins

• Some challenges may include optional or required buy-ins
• Buy-ins are processed through Stripe
• All payments are final once a challenge begins
• Buy-in amounts contribute to the challenge prize pool

Prize Distribution

• Prize pools are distributed according to the challenge rules set by the organizer
• Distribution occurs after challenge completion and verification
• We may deduct a service fee from prize pools (disclosed before joining)
• You are responsible for any tax obligations on winnings

Refunds

• Refunds are available only if you withdraw before a challenge starts
• No refunds are provided after a challenge begins
• If a challenge is cancelled by the organizer, buy-ins will be refunded

7. Challenge Rules and Fair Play

You agree to:

• Participate honestly and not manipulate health data
• Not use automated tools or devices to artificially inflate metrics
• Respect other participants and maintain sportsman-like conduct
• Follow the specific rules set by challenge organizers

We reserve the right to:

• Disqualify participants for cheating or rule violations
• Void challenges where widespread cheating is detected
• Withhold prize distributions pending investigation

8. User Content

You retain ownership of content you create, including:

• Challenge names and descriptions
• Chat messages
• Profile information

By posting content, you grant us a non-exclusive license to display and distribute that content within the Service.

9. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to manipulate or falsify health data
• Harass, abuse, or harm other users
• Create fake accounts or impersonate others
• Attempt to gain unauthorized access to the Service
• Use the Service to launder money or conduct fraudulent transactions
• Interfere with or disrupt the Service

10. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Data Savvy, Inc. and protected by copyright, trademark, and other intellectual property laws.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• Health data will be accurate or complete
• Challenge results will be free from disputes
• Prize pools will always be distributed as expected

13. Limitation of Liability

To the maximum extent permitted by law, Data Savvy, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or health records
• Disputes over challenge results
• Errors in prize pool calculations or distributions
• Third-party payment processor issues
• Health decisions made based on app data

Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Data Savvy, Inc. from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Disputes with other users
• Your violation of any third-party rights

15. Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

16. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:

• Your access to challenges will be revoked
• Pending prize distributions may be forfeited
• Your account data may be deleted after 30 days

You may delete your account at any time through the app settings.

17. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the app or via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
